AI Phone Genius Terms of Service

1. The service

AI Phone Genius provides software for configuring and operating AI voice calling agents, including outbound campaign dialing, inbound answering, lead-response calling, call transcription, and usage-based billing. The platform provides tooling; it does not originate calls on its own initiative.

2. Customer responsibility for lawful calling

You certify that you have a lawful basis to call every contact you upload or connect, including — where required — prior express written consent under the Telephone Consumer Protection Act (TCPA), and that you will honor all opt-out requests immediately. You are solely responsible for the content of your campaigns, the accuracy of the consent records you attach to contacts, compliance with federal and state calling-time restrictions, do-not-call registries, AI-disclosure and call-recording laws, and every other law applicable to your calling programs.

3. Indemnification

You will defend, indemnify, and hold harmless the platform operator, its affiliates, and its suppliers from and against any claims, damages, fines, penalties, and expenses (including reasonable attorneys' fees) arising out of or related to your calling activity, your contact data, your breach of these terms, or your violation of any law — including without limitation TCPA claims, which can carry statutory damages of $500 to $1,500 per call.

4. Billing

Plans are billed monthly in advance. Call usage is debited from your prepaid wallet per second of connected call time at your contracted per-minute rate; calls of fifteen seconds or less are not billed. Wallet balances are non-transferable. Where required, unused balances are refundable on written request at the platform's discretion or as required by law.

5. Suspension

The platform may suspend calling immediately for suspected unlawful activity, abnormal complaint rates, carrier reputation damage, or nonpayment.

6. Data

Call recordings and transcripts are retained per your workspace retention settings and deleted afterward. You are responsible for notifying call participants of recording where the law requires it.
